The following Terms & Conditions shall apply to the relationship between BidderBuddies Corporation, F-18 Silicon view, Near Sky View, Parvat Patia, Surat-395010 Gujarat, India and all subsidiaries of BidderBuddies Corporation, www.BidderBuddies.com ("BidderBuddies"), and the end user ("You" or "Your"). By using BidderBuddies’ services, you accept the following Terms and Conditions, as well as the manner in which BidderBuddies operates. These Terms & Conditions constitute the entire agreement between BidderBuddies and You, and supersede and replace all prior commitments, undertakings or representations, whether written or oral, between You and BidderBuddies with respect of Your use of BidderBuddies.
Information on www.BidderBuddies.com, such as the "How it Works" or "Help" section, are only recommendations and are not intended as guidelines. BidderBuddies is not liable or responsible for the actions of users or other individuals who have read or been informed of such information or other written material.
BidderBuddies undertakes to follow all local tax legislation for the sale of bid packages and goods in the countries in which it operates, such as payment of VAT.
BidderBuddies reserves the right to change these Terms & Conditions at any time without notice to You.
By accepting the Terms & Conditions and/or registering with BidderBuddies, You confirm that You are eligible (as specified in the "Eligibility" section) to use BidderBuddies.
If You do not agree to the Terms & Conditions, please do not use BidderBuddies.
If You access and use any service from BidderBuddies, You agree to and are bound by these Terms & Conditions.
By accepting the Terms & Conditions and/or registering on BidderBuddies, You confirm that You are at least 18 years of age and at least age of majority subject to the laws of the state, city or other legal entity; therefore You can engage in a binding contract. By using BidderBuddies, You warrant that You have the right, authority, and capacity to enter into this agreement and to abide by all of the Terms & Conditions. By registering on BidderBuddies, the user declares that they are legally capable of entering into binding contracts. BidderBuddies employees and their family members may not, under any circumstances, participate in BidderBuddies auctions.
BidderBuddies products and services are offered exclusively to private users and not to commercial or semi-commercial retailers.
BidderBuddies reserves the right to limit the number of user accounts per household. A user may not use any external software to automatically place bids in the auctions.
BidderBuddies reserves the right, at its sole discretion, to deactivate any user’s account based on suspicion of the use of such software.
You hereby declare and warrant that You are at least 18 years of age and at least age of majority subject to the laws of the state, city or other legal entity, therefore You can engage in a binding contract; You reside in a jurisdiction in which BidderBuddies operates; Your user account may be used only by You and not by anyone else. All information that you provide us during the term of validity of this agreement, is true, complete, and correct, and that you shall immediately notify us of any change of such information.
You are allowed to have only one account. If you attempt to open more than one account, all accounts you try to open may be blocked or closed.
As part of the registration process you will have to choose your username and password for your login to BidderBuddies.
During the registration process, you must choose a username, which must not in any way be offensive, indecent, insulting or intended to deceive or mislead other users or persons, whether intentionally or unintentionally.
Nor may a user name advertise for or promote any other websites or services, provide links to or for other websites.
Please note that BidderBuddies reserves the right to change usernames, for whatever reason, and is the final arbiter on policy.
BidderBuddies will never ask for Your password apart from login. You are solely responsible for Your user account password and its preservation. We suggest that you not provide your password to anyone, including BidderBuddies’ employees. User accounts are non-transferable.
We are not responsible for any abuse or misuse of your account by third parties due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party.
Users can place bids by manually clicking the relevant bid button or using the automatic AutoBid function.
AutoBid lets users bid on an auction even when they are not online or logged in. The AutoBid automatically places bids according to the user’s instructions. For more information on AutoBid, visit the "FAQs" section.
Bids are purchased in advance in the form of "Bid Packs". BidderBuddies reserves the right to offer different size Bid Packs at different times; also, BidderBuddies could offer free bids at its sole discretion. All placed bids and free bids are non-refundable. All unused credits are non refundable and non transferable.
With each bid placed, the price of the item on which the user is bidding increases by a small preset amount (10 paisa INR to 50 Paisa INR). Each new bid resets the remaining time for an auction up to the amount specified for the Auction Type (usually 10, 20, 30, 50, and 60 seconds or up to 10 Minutes as specified for that particular auction).
When a bid is placed, number of credits are deducted from the user’s bidding account as per the specified number of credits for that auction. Placed bids are not refundable. An auction closes when no more bids are received by BidderBuddies’ servers. The countdown time is indicated for each auction. Due to the time it takes for bids to reach BidderBuddies’ servers, and in order to allow all users the same opportunity to bid regardless of geographic location, BidderBuddies’ servers will wait for an additional 5 seconds for any placed bids to reach BidderBuddies servers before closing the auction.
The user who was the last to place a bid wins the auction and can purchase the product.
Bids become valid when they are entered in the BidderBuddies database and registered in BidderBuddies’ system. BidderBuddies is not responsible for disruptions in the user’s connection and errors that may occur as a result of this. This includes, but is not limited to, incorrect countdown of the remaining time, outdated information on bidders, and bids.
We may, at our sole discretion, also offer users a "Buy Now" option. The Buy Now option allows a user to buy the auctioned product using up to 89% of the value of the bids already spent in that auction. It gives the user the option to purchase the product by paying the difference between the value of the spent bids in that auction and the product value, which is the suggested retail price. The user may only use the value of the bids he/she has placed in the auction up to the product value. If the value of the placed bids is higher than the product value, then the bids in excess of the product value cannot be used in a Buy Now purchase. The value of any bids spent above the value of the product will not be refunded. The Buy Now purchase price can never be below zero. The user can buy the product using the Buy Now option at any time when the auction is online and up to 24 hours after the auction has closed. When a user decides to buy the product by exercising the Buy Now option, he/she may no longer participate in the auction, any AutoBids that have been placed in that auction will be cancelled and the remaining AutoBid bids returned to the user’s bid account. The auction will continue uninterrupted for all other users. All purchases pursuant to a Buy Now option shall be subject to the user’s payment in full of all amounts due for the product (including all shipping and handling charges) within 24 hours after the auction ends. Unless payment is received in full within this time, the user’s right and Buy Now option to purchase and receive the product is automatically withdrawn and cancelled, and the user shall not be entitled to a refund of any bids placed.
Once an auction is closed, the winner, goes to My Account for information on the total price, including shipping costs, and payment options. Once the auction is closed, the winner has 15 days to pay the total price of the product, by following the steps indicated on the website. After confirming the win and paying the amount due, the winner will receive a confirmation e-mail. BidderBuddies will ship the product within 21 days after payment confirmation is received. The buyer must also provide an accurate delivery address on the account, before BidderBuddies can ship the product. After BidderBuddies has shipped the product, it will take a few days for it to reach the buyer.
If an auction win has not been confirmed and paid within 15 days, the order will be void and cancelled, spent bids will not be refunded.
Unless otherwise specified, delivery will be made from our supplier’s warehouse to the registered address provided by the User.
Deliveries are made solely within the following countries: India & UK
As BidderBuddies works with trusted delivery partners to ensure the best possible service and widest reach, all delivery estimates are for information only and do not constitute binding agreements. Obvious damage to the item or packaging during transit should be reported to the carrier by the winning user, if the item is damaged it should be refused, not signed for. If you wish to claim for concealed defects or damage after signing for an item, you must inform us about the damaged or faulty goods within 3 days of receipt. BidderBuddies cannot accept responsibility for damaged or faulty goods once 3 days have lapsed. In all cases you must inspect your item either at the point of or immediately after delivery. Failure to raise a query with BidderBuddies, concerning a damaged or incorrect item within 3 days of delivery constitutes acceptance of the item as is. BidderBuddies does not accept liability for damage or failure of products due to neglect or misuse by the recipient. In the event that BidderBuddies’s delivery partners are not able to deliver the item within a reasonable time, BidderBuddies shall be entitled to offer the winning User a substitute item with comparable or better features, or to set aside the contract through recission and offer a refund of any payments received for the auction item. This does not affect the User’s statutory rights.
The product will be delivered to the address specified by the user. All technical service and product support matters must be taken up directly with the manufacturer according to their terms. In case of cancellation of an order, only the purchase price will be refunded. So, shipping costs and spent bids will never be refunded. This policy applies both to auctions and Buy Now option. If you decide to return a product/item, BidderBuddies will not refund the value of the placed bids of a purchased product/item.

You may close your account at any time by sending us notification of your intention.
TERMINATION BY BidderBuddies :
BidderBuddies reserves the right to temporarily or permanently terminate Your account at its sole discretion if it determines You have violated these Terms & Conditions, any laws, or the rights of our other users or other third parties. Examples of unauthorized usage include the use of unauthorized third-party bidding or bid tracking software, the creation of multiple accounts by the same individual, or if BidderBuddies suspects fraudulent account activity or behavior.
You agree that if BidderBuddies, in good faith and in its sole discretion, determines that You have breached these Terms & Conditions, BidderBuddies may withhold, cancel or otherwise retain any and all of Your pending deliveries and/or refunds for bids.
Claims for damages by the User against BidderBuddies, its legal representatives, employees or parties who assist in performance are not permitted. In particular, BidderBuddies shall not be liable for faulty operation of the phone or computer hardware/software during bid submission and for incorrect/slow transmission of bidding data by phone/ISP. Should such an event occur, the User shall have no legal rights over the item. User expressly agrees that use of BidderBuddies is at user’s sole risk. BidderBuddies does not guarantee any results that may be obtained from the use of the website. BidderBuddies cannot guarantee continuous access to the service. While we will use all reasonable endeavours to keep an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services. In the event that an auction has closed irregularly, Users will be refunded the bids spent for the item and the auction will be resumed at a later time. BidderBuddies will do its best to notify the User that the auction has closed irregularly as soon as possible. After a technical error, BidderBuddies has the right to restart all auctions from the beginning, once the problem has been rectified. AutoBids may close before the Users wish them to for technical errors. Anyway, BidderBuddies will do its best to restore the users’ AutoBids, which is, however, not guaranteed.
These Terms & Conditions shall be governed and construed in accordance with the laws of India. Furthermore, these Terms & Conditions shall exclude application of the UN Convention on the International Sale of Goods.
